REPRESENTATIVE MATTERS

Daniel has handled various types of cases during his career.  The following is a list of some representative matters Daniel, on his own or with a team, has handled at his former firms and currently.

Real Estate Investment Disputes: 

Represented a member in several commercial real estate investment limited liability companies in multiple lawsuits, one of which was tried successfully over seven days, and in post-trial motions, resulting in client obtaining full ownership in three multi-million-dollar commercial properties.

Guardianship/Sovereign Immunity: 

Co-counseling with Akerman LLP in representing guardians and a guardianship in lawsuit seeking a share of claims bill proceeds awarded to the guardianship under a private act of the Florida Legislature. Three related lawsuits were dismissed in favor of the clients; the fourth remains pending.

Financial Separation:

Represented clients in asset division disputes, ranging from large, closely-held businesses to family-owned real property.

Insurance: 

Represented a multinational insurance company in defense of various claims throughout Florida, including two legal malpractice claims, one of which resolved through a dismissal in favor of the client, and the other of which resolved through a settlement.

Co-counseled with Willkie Farr & Gallagher in representing selling shareholders of insurance companies in related multimillion dollar cases pending in New York state and federal courts over post-sale incentive compensation disputes and requests for indemnification.

Nonprofit: 

Represented a large South-Florida non-profit in its dispute with an affiliate, obtaining a resolution for the client through the subsequent sale of the non-profit to a third party.

Equity Interest Disputes: 

Oversaw expert presentation and cross-examination in representation of owners of closely held engineering business in dispute with claimant to equity interest, successfully defending the allegations through a federal, eight-day trial.

Represented a large food distributor in dispute with former employee claiming rights to portion of distributor’s business.

Hotel Financing Dispute: 

Presented expert portion of representation of New York City developer in hotel financing dispute against international financial institution before the International Centre of Dispute Resolution of the American Arbitration Association, New York.

Corporate Governance:

Representing director and shareholder of closely held infrastructure company in governance disputes.

Commercial Contract Disputes:

Represented a manufacturing corporation in suit to recover for the destruction of hygienic and sterile products caused by infestation of third party warehouse.

Representing national law firm in collection of legal fee.

Trade Secret Dispute:

Represented Boca-Raton based on-line company in bet-the-company lawsuit against competitor claiming that client had infringed trade secrets.  Following successful resolution, continued representing client as outside general counsel.

Employment-related Disputes

Represented employees seeking post-employment payments of salary and contractual severance payments.
